PLEASE NOTE: The agreement below must be read and completed prior to having access to the fitness videos provided by the Township of Emo:
ASSUMPTIONS OF RISK, RELEASE OF LIABILITY AND INDEMNITY AGREEMENT
This form must be completed by each individual who wishes to access and use the videos made available by the TOWNSHIP OF EMO.
This form must be completed by the parent or legal guardian of all individuals under the age of 18. Individuals 18 years of age or older may sign as their own parent/guardian.
In consideration of using the videos provided by the TOWNSHIP OF EMO, the undersigned acknowledges, appreciates and agrees that:
1. I acknowledge that there is at all times a risk of injury from engaging in physical activity. I acknowledge and understand that whilst participating in physical activity while using the videos provided by the TOWNSHIP OF EMO:
• I may be injured, physically or mentally, or may die;

2. I, KNOWINGLY AND FREELY ASSUME ALL RISKS, both known and unknown, and assume FULL RESPONSIBILITY for my participation in physical activity while viewing the videos provided by the TOWNSHIP OF EMO.
3. I, FOR MYSELF, and on behalf of my heirs, assigns, personal representatives and next of kin, hereby RELEASE, INDEMNIFY and hold harmless the TOWNSHIP OF EMO, its council members, agents, contracted video providers and employees from and against any and all actions or claims which may be made by me or on my behalf or by other parties for or in respect of or arising out of any and all injury, disability, death or loss or damage to person or property, arising from my use of the videos and/or programs that are available for use from the TOWNSHIP OF EMO whether by negligence, breach of contract or in any way whatsoever.
I have read this release of liability and assumption of risk agreement. I fully understand its terms. I understand that I may have given up substantial rights by signing it. I sign it freely and voluntarily without any inducement.
For participants under the age of 18 years:
This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above, and, for myself, my heirs, assigns and next of kin, I release and agree to indemnify the TOWNSHIP OF EMO, its council members, agents, contracted video providers and employees from any and all liability incident to my minor child’s involvement or participation in any activities, as provided above.
2. I, KNOWINGLY AND FREELY ASSUME ALL RISKS, both known and unknown, and assume FULL RESPONSIBILITY for my participation in physical activity while viewing the videos provided by the TOWNSHIP OF EMO.
3.
